Man Pleads to Federal Charges

United States Attorney Mary Beth Buchanan announced Monday that James A. Volpe, a resident of Brockport, Pennsylvania, pleaded guilty in federal court in Johnstown to charges of violating various federal laws.

Volpe, age 50, pleaded guilty to three counts before United States District Judge Kim R. Gibson.

In connection with the guilty plea, Assistant United States Attorney John J. Valkovci, Jr., advised the court that on May 17, 2007, Volpe distributed anabolic steroids, and on the same date he mailed anabolic steroids that were misbranded as drugs that require a prescription from a practitioner licensed by law to administer.

On September 12, 2007, Volpe, who had been convicted in 1981 in Orange County, New York, of possession of stolen property, unlawfully possessed a pistol and two rifles. Federal law prohibits persons who have been convicted of a crime punishable by imprisonment for more than one year from possessing ammunition or firearms. Possession of stolen property is such a crime.

Judge Gibson scheduled sentencing for June 23, 2009, at 11:00 a.m. The law provides for a total sentence of 18 years in prison, a fine of $750,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed is based upon the seriousness of the offenses and the prior criminal history of the defendant.

According to Ms. Buchanan, Volpe is being prosecuted as part of Project Safe Neighborhoods, a collaborative effort by federal, state, and local law enforcement agencies, prosecutors, and communities to prevent, deter, and prosecute gun crime.

The Food and Drug Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives conducted the investigation that led to the prosecution of Volpe.
