Sandusky Appeals Conviction

On the day that former FBI director Louis Freeh released his report on how Penn State officials handled the Jerry Sandusky child sex abuse scandal, Sandusky’s lawyers filed a notice of appeal, claiming Judge John Cleland worked against them.

Karl Rominger wrote that Cleland ordered defense counsel to reveal who they shared discovery materials with, which the filing described as being similar to forcing the defense to reveal its “thought process and/or strategies.”

He also said Cleland lacked the authority to retroactively impose such an order, and is an error because it does not require the attorney general's office to make the same disclosure. He also cites Cleland’s denial of continuance requests which, he says, deprived Sandusky of due process.

Sandusky was convicted last month on 45 criminal counts that he sexually abused 10 boys over 15 years and is expected to be sentenced in September.
