DEP, Cuomo Suing PA Power Plant

New York Attorney General Andrew Cuomo plans to sue a Pennsylvania power plant he says violates federal environmental regulations and creates a major source of air and water pollution.

His office is targeting the Homer City Station in Indiana County. Cuomo says the current and former owners failed to install pollution controls required by the federal Clean Air Act after modifications during the 1980s and 1990s increased emissions of sulfur dioxide, nitrogen oxide and soot.

Among the former owners are Penelec and the New York State Electric & Gas Corporation (NYSEG).

Cuomo says the Pennsylvania Department of Environmental Protection will join the action. The law requires 60 days notice before a suit is filed.
