Court Delays Indian Tax Ruling

A New York appeals court has delayed its decision on whether to extend or lift an order blocking the state from collecting taxes on cigarettes sold by Native American retailers to non-Indian customers.

The court didn’t say when it would issue a ruling.

On September 1, a state appellate judge restored a restraining order that kept the state from collecting a $4.35 per pack tax.

A federal judge in Buffalo has already temporarily blocked tax collections from the Seneca and Cayuga nations. The appellate court order will apply all nine tribes in New York.

What I don't understand is if they collect no tax right now why are there gas and cigarettes costs just a little different in price from other places? It's not like there is a super savings people are getting. So someone is making a good amount of money. So to me it's more about not collecting tax, but more about cutting into profits! I think a good way to solve the problem don't force retailers there to collect taxes. Just make it so they can't sell to non-Indians. So there can be no complaint about tax collecting going on because non-Indian's aren't tax exempt like Indian's so why should we not pay taxes? Just something to think about courous what others think about this can't wait to hear everyones feedback!
